Terms of Service

1. Acceptance of Terms

By accessing and using djamee.ai Design Canvas ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time. Your continued use of the Service following the posting of revised terms means that you accept and agree to the changes.

2. Service Description

djamee.ai Design Canvas is a web-based design tool that allows users to upload images, add text, arrange elements on a custom canvas, and export high-resolution designs. The Service operates entirely in your browser—no data is stored on our servers unless you purchase a subscription plan that includes design storage.

Subscription Tiers:

  • Single Export ($0.99): One-time export without storage
  • Monthly ($4.99/month): Unlimited exports with 30-day design storage
  • Lifetime ($19.99): Unlimited exports with 1-year design storage

3. User Rights & License

Your Content: You retain all rights to any images, text, and designs you create using the Service. We do not claim ownership of your designs. You grant us a limited license to store and process your designs only as necessary to provide the Service.

Commercial Use: You may use designs created with djamee.ai Design Canvas for commercial purposes, including selling print-on-demand products, social media content, and professional projects. No attribution to djamee.ai is required (though appreciated).

Restrictions: You may not use the Service to create designs that infringe on third-party intellectual property rights, violate laws, or promote illegal activities.

4. Acceptable Use Policy

You agree not to use the Service for any of the following purposes:

  • Creating designs that infringe on copyrights, trademarks, or other intellectual property rights
  • Creating content that is illegal, defamatory, obscene, or harassing
  • Attempting to gain unauthorized access to the Service or its systems
  • Uploading malware, viruses, or malicious code
  • Reverse engineering, decompiling, or attempting to discover the source code
  • Interfering with the normal operation of the Service or other users' access
  • Using automated tools (bots, scrapers) without explicit permission
  • Creating multiple accounts to circumvent payment or usage limits

5. Payment Terms

Payment Processing: All payments are processed through Stripe. By making a purchase, you authorize us to charge your payment method for the selected plan.

Billing: Monthly subscriptions renew automatically on the same day each month. You will receive a reminder email before renewal. You may cancel your subscription at any time through your account settings.

Refunds: Single exports ($0.99) are non-refundable. Monthly subscriptions may be refunded within 7 days of purchase if unused. Lifetime purchases ($19.99) are non-refundable after 7 days of purchase. Refund requests must be submitted to [email protected].

Taxes: You are responsible for any applicable sales taxes on your purchases. We will collect and remit taxes as required by law.

6. Access Codes & License Keys

After purchase, you receive a unique access code (e.g., DJAM-XXXX-XXXX-XXXX) that unlocks your purchased exports. Access codes are:

  • Personal and non-transferable (sharing codes with others is prohibited)
  • Valid on any device (enter the code in the app to unlock features)
  • Stored in your browser's localStorage for convenience
  • Subject to revocation if used in violation of these terms

7. Limitation of Liability

AS-IS SERVICE: djamee.ai Design Canvas is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or secure.

NO LIABILITY FOR DAMAGES: To the fullest extent permitted by law, djamee.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

LIABILITY CAP: Our total liability to you for any claims arising from the Service shall not exceed the total amount you have paid to djamee.ai in the 12 months preceding the claim.

DATA LOSS: While we implement security measures, we are not responsible for loss, corruption, or unauthorized access to your designs. We recommend regularly exporting and backing up your work.

8. Indemnification

You agree to indemnify, defend, and hold harmless djamee.ai, its owners, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of third-party rights through designs you create.

9. Intellectual Property Rights

Our IP: djamee.ai Design Canvas, including its software, interface, features, and functionality, is owned by djamee.ai and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or modify any part of the Service without permission.

Fonts & Assets: All fonts and design assets included in the Service are licensed for personal and commercial use. You may use them in designs created with our tool, but you may not extract or redistribute them separately.

10. Data & Privacy

Your use of djamee.ai Design Canvas is also governed by our Privacy Policy. We do not collect, store, or transmit your images unless you purchase a subscription plan with storage. For details on how we handle your data, please review our Privacy Policy.

11. Termination

We may terminate or suspend your access to the Service immediately, without notice, if you violate these terms, engage in illegal activity, or abuse the Service. Upon termination, your access code becomes invalid, and any stored designs may be deleted.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for partial months.

12. Dispute Resolution

Informal Resolution: If you have a dispute with djamee.ai, please contact us at [email protected] with details of the issue. We will attempt to resolve disputes informally within 30 days.

Governing Law: These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding relating to your use of the Service shall be brought exclusively in the courts located in the United States.

13. Third-Party Services

The Service uses third-party services including:

14. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable for any loss or damage resulting from modifications or discontinuation of the Service. We will provide notice of major changes when possible.
